Terms of Service

Terms for Avalon Labs LLC's optional Cloud accounts and synchronization, including local use, account security, subscriptions, retention and deletion.

Effective October 22, 2026. These terms apply to Avalon Cloud operated by Avalon Labs LLC at getavalon.app. Service and support contact: [email protected]. Cloud service is offered outside mainland China.

1. Agreement and eligibility

By creating a Cloud account or using Cloud services, you agree to these terms with Avalon Labs LLC. The public website explains the service; simply reading it does not subscribe you to a paid plan. Cloud is offered in countries and regions outside mainland China, subject to applicable restrictions. You must have legal capacity to use the service or the authorization required from your parent or guardian. You are responsible for checking whether your intended use is lawful where you are located.

2. Free local use and optional Cloud features

Avalon's local functionality is free and works offline. A Cloud account and any paid sync entitlement are optional. Signing out, entitlement expiry, account deletion or a Cloud outage must not prevent local use or erase local content. Cloud provides account and device management and, where made available to your account, synchronization of supported content. A website description is not a promise that every client, platform or payment channel already supports a feature; availability is shown in the relevant application or purchase flow.

3. Account security and devices

Cloud supports email verification and, where available in your client, Apple or Google sign-in. Keep control of your email account and protect your verification codes, device access and account tokens. Do not transfer account access or impersonate another person. A sync entitlement supports up to 10 activated devices; removing a device revokes its Cloud sessions and synchronization access without deleting that device's local content. Inform us promptly if you suspect unauthorized access. We may require identity verification before acting on sensitive account requests.

4. Your content and acceptable use

You retain your rights in content you upload. You authorize Avalon Labs LLC and its necessary service providers to store, process, transmit and back up that content only to deliver, protect and maintain the service and meet applicable legal obligations, subject to the Privacy Policy. You must have the rights and permissions needed for content and credentials you synchronize. Do not use Cloud for unlawful activity, infringement, unauthorized access, distributing malicious content, bypassing account or device limits, or disrupting the service. Avalon Cloud does not itself supply proxy connectivity or rights to use third-party services.

5. Synchronization, encryption and your own copies

Sync transfers supported content among activated devices and applies the relevant synchronization rules. Cloud encryption keys are managed by the service, with access restored through verified account recovery. Authorized service processing can decrypt cloud content, so this is not end-to-end encryption. Local device keys remain separate. Keep your own copies of important configurations and credentials and review the content before rebuilding a cloud space. Synchronization and disaster-recovery backups are not a guarantee that every historical version can be restored.

6. Purchases, cancellation and refunds

Where purchasing is offered, the purchase screen and applicable store or payment-channel terms disclose the price, currency, taxes, duration and any renewal conditions before you pay. These terms do not create an undisclosed recurring charge. Manage cancellation and renewal through the channel used to purchase. Deleting a Cloud account or removing an app does not automatically cancel a store subscription. Refund requests follow applicable law and the purchase channel's process; mandatory cancellation, withdrawal and refund rights remain available. No payment is collected merely by visiting this website. An Avalon account is intended to have one current subscription across all channels; use the existing channel to manage it instead of buying again elsewhere. If an external store action or delayed payment creates a duplicate, contact support to reconcile it; overlapping purchases do not add days or device allowances. Account deletion does not transfer old data or paid periods. A new account may receive a genuinely new paid period only when the channel proves a new purchase and account binding, with previous operations resolved.

7. Expiry, retention and renewal

For accounts explicitly using the newer lifecycle policy, entitlement expiry immediately stops Cloud uploads and downloads. Cloud content is retained for 30 consecutive 24-hour periods in UTC after expiry. A qualifying renewal within that period can restore access; once it ends the previous cloud space is permanently retired and its online content is scheduled for removal. Renewing later does not restore that space: a new one must be rebuilt from an eligible device's local content. Restoring a disaster-recovery copy cannot reopen a retired space. An account that has not explicitly migrated keeps its earlier retention commitments; we will communicate migration terms before applying a change. Account access and local content are not deleted just because a sync entitlement expires.

8. Account deletion and ending use

You may stop using Cloud at any time and request deletion through getavalon.app/account/delete after email verification and confirmation, or contact support. Deletion removes the online account and cloud content and revokes its sessions, while preserving local device content. A later account created with the same email address has a new identity and does not inherit the deleted account's cloud content or entitlements. Controlled disaster-recovery copies under the newer policy expire no later than 30 days after their original UTC creation; they remain potentially decryptable during retention and are subject to the restore exclusions described in the Privacy Policy. Minimal deletion and retirement records may be retained to enforce these exclusions. Cancel any continuing store subscription separately.

9. Availability, restrictions and responsibility

We take reasonable steps to keep the service secure and available, but network interruptions, maintenance and technical failures can occur. We will give reasonable notice of planned material interruptions where practicable. We may restrict access where reasonably necessary to address a security incident, unlawful use or a serious breach of these terms, and will explain the reason and offer a contact for review when legally and technically possible. Our responsibility for loss and any remedies are determined by applicable law; these terms do not exclude liability that cannot lawfully be excluded or reduce mandatory consumer rights. You remain responsible for lawful use and protecting your own devices and copies.

10. Changes, disputes and contact

Material changes will be communicated with an effective date and appropriate advance notice; any consent required by law will be requested. Changes do not retrospectively remove mandatory rights or an existing retention commitment. For support or a dispute, contact Avalon Labs LLC at [email protected] so we can seek a resolution. These terms impose no mandatory private arbitration and do not prevent you from seeking remedies from a court, regulator or consumer body with jurisdiction under applicable law. The English and Simplified Chinese versions describe the same service; neither version overrides mandatory protections available to you.
